These Operating Rules, (Site Agreement), constitute your agreement with the author (PhotoCop Consulting)  with respect to your use of the www.PhotoCop.com World Wide Web site (the "Site). You must agree to abide by all of the terms and conditions contained in these Operating Rules in order to become or remain an authorized user of the Site (a "User"). PhotoCop may modify these rules at any time upon posting notice on the Site.

IF THESE OPERATING RULES OR ANY FUTURE CHANGES ARE UNACCEPTABLE TO YOU, YOU MAY IMMEDIATELY TERMINATE YOUR SITE VISITATION AS PROVIDED IN THE SITE AGREEMENT. YOUR CONTINUED USE OF THE SITE NOW, OR FOLLOWING THE POSTING OF NOTICE OF ANY CHANGES IN THESE OPERATING RULES, WILL CONSTITUTE A BINDING ACCEPTANCE BY YOU OF SUCH RULES OR CHANGES.

PhotoCop may change or discontinue any aspect of the Site at any time, including, but not limited to, the availability of any Site feature, database or content.

2.0 FAIR USE

This site is provided for research purposes only. Some material presented in this site is provided under the doctrine of Fair Use as applied to the U.S. Federal copyright statutes. All non-original material is so indicated and a citation is included as to the source and rightful copyright holder.

3.0 USAGE RESTRICTIONS

The entire contents of this site, unless otherwise specificly noted, is copyrighted under United States law. This site is a publication of  PhotoCop.  The analyses, conclusions, and opinions expressed in this publication are those of PhotoCop. Materials from the www.photocop.com   This site may be freely referenced by hyperlink. All material on this site is provided for lawful purposes only. PhotoCop reserves complete title and full intellectual property rights for materials downloaded from the site.

User may download or copy Content accessed through the Site, for personal use, including internal business use in the ordinary course of User's business or profession, provided that User maintains all copyright and other notices contained in such Content.  In no event may User, directly or indirectly, sell or offer for sale any Content accessed through the Site or upload, distribute, or otherwise publish such Content in any form or medium except for occasional communications and memoranda. User shall not store any significant portion of any Content owned by, or licensed to, PhotoCop, including but not limited to any Content accessible through
the  Site, in any form, whether archival files, computer-readable files or any other medium.

User expressly agrees that he/she shall not directly or indirectly publish, broadcast or distribute Content accessed through the Site in any form or medium, except that governmental and institutional Users may use individual items of such Site for occasional internal communications and memoranda.

4.0 ACCESS TO SITE

User must provide, at User's own cost, all telephone and other equipment necessary to access and use the Site and shall be responsible for all charges necessary for such access and use.

5.0 SUBMISSIONS TO WWW.PHOTOCOP.COM

Any information, including but not limited to remarks, suggestions, ideas, graphics or other submissions, communicated to PhotoCop through this site is the exclusive property of PhotoCop. PhotoCop is entitled to use any information submitted for any purpose without restriction or compensation to the person sending the submission.

By uploading to, or distributing or otherwise publishing through, the Site (except by use of private e-mail) any Content, User grants PhotoCop the right to edit,
copy, remove, distribute, create derivative works from and publish such Content in any form and medium, whether electronically or in hard copy and whether alone or as part of a collective work. Notwithstanding the foregoing, User shall retain whatever rights he/she has in such Content.

The user acknowledges the originality of any submission communicated to PhotoCop and accepts responsibility for its accuracy, appropriateness and legality.

6.0 LIABILITY RESTRICTIONS

The information provided in this site is provided "as is" without warranty of any kind. PhotoCop disclaims all warranties, either express or implied, including the warranties of merchantability and fitness for a particular purpose. In no event shall PhotoCop be liable for any damages whatsoever including direct, indirect, incidental, consequential, loss of business profits or special damages, even if PhotoCop has been advised of the possibility of such damages including, but not limited to, technical, hardware or software failures of any kind; lost or unavailable network connections; incomplete, garbled or delayed computer transmissions.PhotoCop provides links to other sites that are not maintained by PhotoCop. PhotoCop does not endorse those sites and is not responsible for the content of such other sites. Some states do not allow the exclusion or limitation of liability for consequential or incidental damages so the foregoing limitation may not apply.

7.0 APPLICABILITY OF CONTENT

Information on this site includes descriptions of products and Sites that may be available in the United States of America only. This site is operated in the State of Texas, United States of America, and the information provided is applicable or appropriate for use in other locations.

8.0 SITE CONTENT

8.1 User shall not upload to, or distribute or otherwise publish through, the Site any Content which violates or infringes the rights of any persons, including but not limited to, rights in copyrights, patents, trademarks, trade secrets and other proprietary rights.

8.2 User shall not upload to, or distribute or otherwise publish through, the Site any Content which is libelous, defamatory, obscene, pornographic, abusive or otherwise violates any law, or which contain viruses, "worms", "Trojan horses" or any other harmful properties, or use the Site for, or to further, any illegal purposes.

8.3 User shall not, without the express approval of PhotoCop, upload to, or distribute, broadcast (by e-mail or otherwise) or otherwise publish through, the Site any Content containing any solicitation of funds, advertising or solicitations for goods or Sites, except that such restriction shall not prevent User from sending private e-mail in the ordinary course of business.

9. PHOTOCOP RIGHTS TO EDIT OR DELETE CONTENT

PhotoCop reserves the right in its sole discretion to edit or to delete any Content displayed, uploaded to, or distributed, or otherwise published through the Site
(other than Content in private e-mail communications).

10. SOFTWARE LICENSE

User shall have no rights to the proprietary software and related documentation, or any enhancements or modifications thereto, provided to User to access the Site (the "PhotoCop Software") except as provided in the Site Agreement. User may not sublicense, assign or transfer the license granted in paragraph 3 of the Site Agreement or the PhotoCop Software and any attempt at any such sublicense, assignment or transfer is void. User may copy the PhotoCop Software for archival purposes only. Except as expressly provided under the Site Agreement, User may not copy, distribute, modify, reverse engineer, or create derivative works from the PhotoCop Software.

11. ENFORCEMENT OF TERMS AND CONDITIONS

These terms and conditions are governed and interpreted pursuant to the laws of the State of Texas, United States of America, notwithstanding any principles of conflicts of law. If any part of these terms and conditions is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of remaining provisions. PhotoCop can revise these terms and conditions at any time by updating this posting.

PhotoCop may terminate this agreement at any time without notice for any reason. Users may terminate this agreement by destroying all materials obtained from the the site.

12. COMPENSATION DISCLAIMER

Some information in www.photocop.com has been supplied by vendors. However, no compensation has been provided to PhotoCop for inclusion of any photo-enforcement product information contained in its pages.

13. COPYRIGHTED MATERIAL

"PhotoCop™" is the trademark of PhotoCop Consulting.  Individual items of information, software and other material ("Content") accessible through the Site may be protected by copyright. User may not copy, upload, distribute or otherwise publish any Content protected by copyright, without obtaining permission of the copyright owner. User agrees to abide by any copyright notice or other restriction contained in any individual Content accessed through the Site. The Site is copyrighted as a collective work under United States copyright laws. Except as expressly provided in these Operating Rules or in the Site Agreement, User shall not copy, distribute, publish, or create a derivative work from the Site or any part thereof.

14. PRODUCT NAMES

THE PRODUCT NAMES IN THIS DOCUMENT ARE TRADEMARKS OR REGISTERED TRADEMARKS OF THEIR RESPECTIVE OWNERS. PLEASE CONTACT MANUFACTURERS FOR CURRENT INFORMATION ABOUT THEIR PRODUCTS AND SERVICES.

15. TERMINATION

PhotoCop may, in its sole discretion, terminate User's site visitation privilege, or suspend User's access to all or part of the Site, for any reason.
